1. Eligibility

You must be at least 18 years old and legally able to enter into contracts. By using Buildasy, you represent that all information you provide is accurate and complete.

2. Nature of the Platform

• Buildasy provides technology tools that allow Builders and Investors to connect, share project information, and explore potential financing opportunities.
• Buildasy is not a lender, broker, financial advisor, or party to any transaction.
• All financing discussions and agreements occur directly between the parties. Buildasy does not guarantee funding, rates, approval, or eligibility.

3. User Accounts

• You are responsible for maintaining the confidentiality of your account and login credentials.
• You agree to notify us immediately of unauthorized access to your account.
• We may suspend or terminate accounts that violate these Terms.

4. User Responsibilities

You agree to:

• Provide truthful, accurate, and updated information.
• Use the platform only for lawful purposes.
• Respect the privacy and rights of other users.
• Comply with all applicable federal, state, and local laws, including lending and real estate regulations.
• You must not upload or share content that is illegal, fraudulent, misleading, harmful, defamatory, or infringes on any intellectual property rights.

5. Project and Investment Information

• Builders and Investors are solely responsible for all project data, financial terms, documents, and representations made on the platform.
• Buildasy does not verify the accuracy, completeness, or legality of any information posted by users.
• Users understand that any investment or financing decision involves risk, and Buildasy does not endorse or recommend any project or user.

6. No Guarantee of Funding

Registering or submitting information on Buildasy does not guarantee financing or approval, investment interest, eligibility for any loan product, or any specific outcome. All funding decisions are made exclusively by the participating Investors.

7. Communications

You agree that Buildasy may contact you by email or other electronic means regarding platform updates, notifications, or required account communications.

8. Fees

• Buildasy may offer free and paid features. Fees will be posted clearly before purchase.
• All fees are non-refundable unless required by law.

9. Privacy

Our Privacy Policy governs how we collect, use, store, and share your information. By using Buildasy, you consent to the practices described in the Privacy Policy.

10. Intellectual Property

• All Buildasy content, branding, software, and features are owned by Buildasy or its licensors.
• Users retain ownership of content they submit but grant Buildasy a non-exclusive license to display, process, and distribute it as needed to operate the platform.

11. Prohibited Use

• Attempt to bypass system protections or access other users’ data.
• Scrape or harvest platform data.
• Use the platform for spam, solicitation, or advertising outside intended functions.
• Post false, misleading, or fraudulent content.
• Engage in activities that could harm Buildasy or its users.

12. Third-Party Services

Buildasy may integrate with third-party tools or services. We are not responsible for their content, availability, or actions.

13. Disclaimers

• Buildasy is provided on an “as-is” and “as-available” basis.
• We make no warranties, expressed or implied, regarding accuracy or completeness of information, availability or reliability of the platform, suitability of any Builder, Investor, or project, or financial or investment outcomes.
• Use of Buildasy is at your own risk.

14. Limitation of Liability

To the fullest extent permitted by law, Buildasy is not liable for any direct, indirect, incidental, or consequential damages; financial losses, investment losses, or lost opportunities; errors or omissions in user-generated content; or disputes between Builders and Investors. Our maximum liability for any claim will not exceed the amount paid by you to Buildasy in the 12 months prior to the claim.

15. Indemnification

You agree to indemnify and hold Buildasy harmless from any claims, damages, or losses arising from your use of the platform, your violation of these Terms, your content or representations to other users, and transactions or agreements between Builders and Investors.

16. Modifications

We may update these Terms at any time. Changes take effect upon posting. Continued use of Buildasy means you accept the updated Terms.

17. Termination

We may suspend or terminate your account for violations of these Terms or for any reason at our discretion. Upon termination, your right to use the platform ends immediately.

18. Governing Law

These Terms are governed by the laws of the State of California. Any disputes will be resolved in state or federal courts located in California.
